Cutest Dog 2014 - Official Contest Rules

These contest rules are specific to the above contest conducted by Entercom Milwaukee, LLC d/b/a WXSS-FM (“Station”).  Except to the extent specifically set forth below with respect to this specific contest, the Station’s general contest rules apply to this contest as well.  A copy of these specific contest rules and the Station’s general contest rules are available at the Station’s studio at 11800 West Grange Avenue, Hales Corners, WI, 53130 during regular business hours and on the contest page on the Station’s website at www.1037kissfm.com. To the extent that the general contest rules differ from these rules, these rules will govern and control with respect to this Contest.

1. No purchase is necessary to enter or win 103.7 KISS-FM’s Cutest Dog 2014 (“Contest”). 

2. The contest entry period will begin at 12:00am (CT) April 7^th, 2014 and end at 5pm (CT), April 11^th, 2014.

3. Persons eighteen (18) years of age or older wishing to enter this Contest (each an “Entrant”), must go to www.1037kissfm.com and click on the graphical “Cutest Dog” entry link.

4. The entry/registration process will require you to either log into an existing account, or create a free account with the game administrator, UPICKEM. You may either elect the option to have your Facebook profile pre-load applicable portions of the entry form (Facebook account is not required to enter this contest), or complete the online entry/registration form by submitting the Entrant’s name, address, phone number and e-mail address. Limit one registration per e-mail address and limit one qualified entry per registration. Multiple entries from the same email will be discarded. Only the first chronologically qualified entry will be considered. All subsequent entries will be discarded.

5. Click on the “Upload Photo” tab and:

a.           Submit only one (1) photograph of your dog, and only your dog (no people or other animals), in either the “.jpeg” or “.jpg” file format (no other formats will be accepted),

b.           Enter your dog’s first name and the town/city where you live, and

c.            Affirmatively check the box or “I agree” button, expressly confirming the following:

·        Entrant represents and warrants that he/she is both eighteen (18) years of age or older and a Wisconsin or Illinois resident.

·        Entrant represents and warrants that they are the owner of the dog depicted in the photo. Station is under NO OBLIGATION to verify whether the entrant who submitted the photograph (or winner if selected as the winning entry in this contest), is or is not the legal owner of the pet depicted in the photograph.

·        Entrant represents and warrants that he/she own the rights to, or has obtained permission to use, the photo submitted with the entry. 

·        Entrant represents and warrants that he/she authorizes Station to post the photo on Station’s website or social network sites or use the photo in any other way Station sees fit.

·        Entrant agrees and acknowledges that Station, all contest sponsors, and their respective affiliates, parents, employees, agents and all other related sponsors: may use the Entrant’s name, image, photo submission, other entry materials and/or biographical information for advertising and/or promotional purposes on radio, TV broadcasts, in the newspaper, on websites and/or any other medium in connection with participation in this contest or otherwise without the payment of any additional compensation.

·        Entrant understands and agrees that Station shall be the sole and exclusive owner of the photo submitted, whether or not the photo is selected as a winner, and entrant agrees to sign any documents requested by Station to evidence such transfer of ownership.

·        By submitting a photo in a Station contest, entrant agrees to indemnify Station should any representations and warranties made by entrant herein or in the applicable contest rules prove to be false or inaccurate.

·       Entrant acknowledges and agrees that the contest rules are available to him/her at www.1037kissfm.com, that he/she has had an opportunity to review them before entering this contest, and agrees to be legally bound by the contest rules.  Contest rules are also available Monday through Friday (excluding holidays) during normal business hours between 8am (CT) and 5pm (CT) at the Station’s studios located at 11800 West Grange Avenue, Hales Corners, WI, 53130.

6. Photo requirements:
1. For purposes of this contest, the terms "photo" or "photograph" may be used interchangeably to include, but not be limited to the inclusion of, any image that may be produced by an analog or digital camera, by an optical image scanner (or simply, "scanner"), by means of a "screen dump," "screen capture," "screenshot," or "screengrab," and/or by the digital manipulation of one or multiple photographs such as may be achieved using image editing software.
2. The photo must be uploaded in either the ".jpeg" or ".jpg" file format (no other formats will be accepted), using the method described in Section 5 above.
3. Photo entries must not contain or depict any registered trade/servicemark or other copyrighted material other than those owned or licensed by the Entrant, or the Station, or a Contest Sponsor.  The foregoing is not intended to require Station to disqualify entrants who, in Station's sole discretion, appear to be innocently wearing clothing or are in areas that just happen to contain third party logos or marks.  Further, Station may, but is not obligated to pixilate/cover any trademarks/servicemarks/copyrighted materials in Station's sole discretion.
4. Only one (1) photo may be submitted for entry in this contest 1) by any one (1) Entrant who must be both eighteen (18) years of age or older and the owner of the dog depicted in the photo, and 2) depicting only their one (1) dog.
5. If you have more than (1) dog, you will only be able to enter (1) dog in the contest.
7. No person or other animal (other than the one (1) dog depicted) may be depicted in any way in the photograph (not even the entrant), and by entering this Contest, the Entrant consents to use of the photograph by Station in any manner it sees fit with no compensation to the Entrant.  Any photograph with any other person(s) or animals depicted in it, no matter how far away or obscure, will be deemed ineligible and thereafter disqualified. 

8. By entering this Contest, the Entrant consents to use of the photograph by Station in any manner it sees fit with no compensation to the Entrant. 

9. Each Entrant may submit only one (1) entry per email in this contest and Entrant must be the owner of the dog depicted in the photo. Station is under NO OBLIGATION to verify whether the entrant who submitted the photograph, selected as the winning entry in this contest, is or is not the legal owner of the pet depicted in the photograph.  Station will discard multiple entries from the same Entrant (whether containing photos of the same or of different dogs) and only the first qualifying entry received will be eligible to participate.

10. Station will discard multiple entries received by same Entrant in Contest, whether photograph submitted as entry is of the same or of a different dog, and only the first qualified entry to be received by Station, in chronological order, from particular Entrant will be eligible for entry in Contest. 

11. By entering this contest, Entrants understand and agree that Station may elect to use any entry submitted for entertainment purposes on-air and may choose to comment on, mock, poke fun at, and/or mimic any entry submitted.  Entrants waive any right to make any claim against Station or any contest sponsors with respect to any comments - disparaging or otherwise - made on-air regarding such Entrant’s entry. 

12. By submitting a photo to the Station for this contest, each Entrant authorizes the Station to post such photo to the Station’s website at www.1037kissfm.com.  Station will not post all entry photos received on the Station’s website. 

13. Photograph entries must not contain any indecency, profanity or obscenity as determined by Station in its sole discretion. Photograph entries must not contain or depict any registered trade/servicemark or other copyrighted material other than those owned or licensed by the entrant, the Station, or a Contest Sponsor.  BY ENTERING THIS CONTEST AND SUBMITTING PHOTOGRAPH, THE ENTRANT IS REPRESENTING TO STATION THAT THE USE AND DISTRIBUTION OF SUCH PHOTOGRAPH WILL NOT VIOLATE OR INFRINGE UPON THE RIGHTS OF ANY THIRD PARTY, INCLUDING, WITHOUT LIMITATION, COPYRIGHTS OF OTHERS.  By submitting a photo, Entrants agree to indemnify Station should any representations and warranties in these contest rules prove to be false or inaccurate.

14. The Grand Prize Winner will be determined in the following manner:
1. At approximately Noon (CT) on April 14^th, 2014, Station will post photos of all eligible entries online at the Station’s website, www.1037kissfm.com. Listeners will then be able to vote for their favorite dog from among all photo entries posted online as many times as they wish  (subject to Station’s right to implement limits as set forth in the general contest rules) until 12pm (CT) on April 18^th, 2014.  LISTENER VOTES WILL NOT BE A DETERMINING FACTOR IN THE SELECTION OF QUALIFIERS BUT MAY BE, IN STATION’S SOLE DISCRETION, ONE OF MANY FACTORS TAKEN INTO CONSIDERATION IN SELECTING QUALIFIERS.

                                                     i.     On or about 4:30pm (CT) on April 21^st, 2014, up to fifty (50) entries (each a “Qualifier”) will be selected by Station staff and/or management from among all entries received to continue to the next round of the contest, based on evaluation of the submitted photo(s) (in their subjective opinion) and/or any other any lawful criteria Station judges deem desirable (the “Qualifiers”).

                                                   ii.     In the event that the Station receives fewer than fifty one (51) entries, this first voting round will not end as scheduled but will continue until the end of the next scheduled voting week in which the planned remaining number of Qualifiers is below the original total.

2. At approximately 5pm (CT) on April 21^st, 2014, Station will post the photos of the Qualifiers online at the Station’s website at www.1037kissfm.com. Listeners will then be able to vote for their favorite dog from among the Qualifiers then posted online as set forth above in Section 14(a) of these rules (i.e. voting will not be determinative)  until 12:00pm (CT) on April 25^th, 2014.

15. After 12:00PM (CT) on April 25^th, 2014, Station staff and/or management will select the potential grand prize winner from among the Qualifiers, based on evaluation of the submitted photo (in their subjective opinion) and/or any other any lawful criteria Station judges deem desirable, subject to verification of eligibility and compliance with these contest rules. Station judges may take the number of votes received into consideration (but is not obligated to) but voting will not be a determining factor in the selection of the winner. 

16. Station will announce the name of the grand prize winner on-air at approximately 7am (CT) on April 28^th, 2014. The potential grand prize winner need not listen in order to win. Station will contact the potential grand prize winner.  Should the potential grand prize winner not meet the eligibility requirements or is disqualified for any other reason, an alternate grand prize winner may be selected by Station, but in the event such alternate grand prize winner does not meet eligibility requirements or is disqualified, no grand prize will be awarded in this Contest.

17. Station will only award one (1) Grand Prize in this contest. The Grand Prize is valued at approximately $1000, and consists of the following:

• Four (4) $250 Pick ‘n Save Gift Cards, and courtesy of Pick ‘n Save and Purina
• (1) $250 prize package courtesy of Animal Campus, which includes $100 gift certificate for the Animal Campus Vet Clinic, $50 gift certificate for the Animal Campus Klippers Grooming and $100 gift basket with dog and cat items

18. The prize will be awarded to the verified Entrant only. 

19. The sponsors of this contest are Pick ‘n Save, Purina, Animal Campus and Entercom Milwaukee, LLC.

20. Station is conducting this contest using proprietary software owned by a third party known as Second Street Media Inc. (“UPICKEM”).  UPICKEM is not a sponsor of this contest but entrants may be required, as part of the entry process, to agree and consent to UPICKEM’s Terms of Service and Privacy Policy (both of which are available via a link during the contest entry process) (collectively, the “UPICKEM Policies”) and may be required to register with UPICKEM.  While agreement to the UPICKEM Policies is required in order to enter this contest, the UPICKEM Policies are not a part of these contest rules but are a separate agreement between the entrant and UPICKEM.  With respect to the conduct of this contest by Station, in the event of any conflict between the UPICKEM Policies and the Station contest rules, the Station’s contest rules govern.

21. Station is not responsible for any error or technical malfunctions associated with the UPICKEM site that may affect any entrant’s ability to enter, win, or be properly considered in this Contest, regardless of the cause. In the event of a malfunction associated with the UPICKEM site that Station (in its sole discretion) deems to materially and adversely affect this Contest, Station reserves the right to suspend this contest, terminate this contest without a winner, terminate this contest and select a winner early, provide alternative means of entry or any other changes to these contest rules that Station deems appropriate under the circumstances. Any such changes, terminations or suspensions will be announced on air and/or posted on the Station’s website, if applicable.

22. Employees of UPICKEM and its affiliates, their respective parents, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible to win in this Contest.
